1 MURRIETA VALLEY UNIFIED SCHOOL DISTRICT DISTRICT ENGLISH LANGUAGE ADVISORY COUNCIL BYLAWS ARTICLE I Name of the Committee The name of this committee shall be the Murrieta Valley Unified School District English Language Advisory Council (DELAC). ARTICLE II Purpose of the DELAC The purpose of the DELAC shall be to: A. Advise the District and staff on development of a detailed plan for English learning education for the District B. Assist in the development of the District s needs assessment C. Review and advise on the administration of the District s language census D. Assist in finding ways to make parents aware of the importance of regular school attendance. The following records relating to the DELAC are to be kept at the District s main office: A. A list of the persons selected to the DELAC by name, address, and telephone number B. A schedule of dates and locations of DELAC meetings C. A copy of the minutes of the DELAC meetings ARTICLE III Membership Composition of the DELAC and Mode of Selection A. The DELAC shall be composed of: Parents will be elected by majority vote of those parents (of EL children enrolled in the English Learner program at the school) present at the announced election meeting. Administration, teachers, classified staff and citizens who work or reside in the service area of the District. B. Notification of the election meeting of the DELAC shall be sent to the parents of all students at least one (1) week in advance of the election meeting. C. DELAC members representing parents and/or other community members shall not be employees of the District. Normal Duties of the Members of the DELAC It shall be the duty of all elected DELAC members to: A. Attend all meetings.

2 B. Accept positions as subcommittee members and/or officers when so appointed or elected unless unable to carry out the duties such membership entails. ARTICLE IV Officers of the DELAC The officers of the DELAC shall be a president, a vice-president, and a secretary. President. Vice-President. Secretary. The president shall preside at all meetings of the DELAC and may sign all letters, reports, and other communications of the DELAC. In addition, the president shall perform all duties to the office of president and such other duties as may be prescribed by the DELAC from time to time. The duties of the vice-president shall be to represent the president in assigned duties and to substitute for the president during his or absence. The vice-president shall perform such other duties as from time to time may be assigned by the president or by the DELAC. The secretary shall keep the minutes of the meetings, both regular and special, of the DELAC, keep a register of the address and telephone number of each member of the DELAC which shall be furnished to the secretary by such membership in general, and perform all duties as from time to time may be assigned to the office by the president or by the DELAC. Election of Officers and Term of Office A. The officers of the DELAC shall be elected annually and shall serve for one year until each successor has been elected. B. All officers shall be elected by ballot at the first meeting of the school year. C. New officers shall assume their duties at the close of the election, meeting. D. Should an officer resign before new elections are held or be absent without a valid excuse for three (3) consecutive meetings, the president shall appoint an alternate member in good standing to assume the office until the next regular meeting when the vacancy can be filled. E. If an officer is absent more than 3 meetings, without a valid excuse, the presiding officer will declare the office vacant and a new officer will be elected. ARTICLE V Meetings of the DELAC Meetings of the DELAC The DELAC shall meet regularly at least once per quarter. Notice of Meetings Public notice shall be given of regular meetings at least one (1) week in advance of the meeting. Any change in the established date, time, or location must be given special notice. All meeting changes shall be publicized. Any such notice shall be in writing; shall state the day, hour, and location of the meeting; and shall be sent home with the parents child, delivered personally, or by mail to each DELAC member. Section 3. Special Meetings Special meetings may be called by the president or by majority vote of the DELAC. Notice shall be given of special meetings at least 48 hours in advance of the special

3 meeting and shall be delivered in writing either personally or by mail to each DELAC member. Section 4. Place of Meetings The DELAC shall hold its regular monthly meetings and its special meeting in a facility provided by the District and readily accessible to all members of the public, including handicapped persons. Section 5. Quorum The presence of a simple majority of the total membership, or elected alternates serving for regular members, shall be required in order to constitute a quorum necessary for the transaction of the business of the DELAC. Decisions of the DELAC shall be valid when a majority vote is obtained. Section 6. Decisions of the DELAC All decisions of the DELAC shall be made only after an affirmative vote of a majority of its members in attendance, provide a quorum is in attendance. Section 7. Conduct of Meetings All regular and special meetings of the DELAC shall be conducted in accordance with Robert s Rules of Order or in accordance with an appropriate adaptation thereof. Section 8. Meetings Open to the Public All regular and special meetings of the DELAC and of its standing or special committees shall be open at all times to the public. ARTICLE VI AMENDMENTS These bylaws may be amended at any meeting, by a two-third-majority vote of a quorum of a quorum being present. The meetings will be governed by these bylaws, and any dispute will be settled by Robert s Rules of Order. A parliamentarian shall be elected by the majority at the first meeting of the newly elected DELAC.

Una copia de las minutas de las juntas del ELAC ARTÍCULO III Membresía Sección 1. Composición del ELAC y Modo de Selección A. El ELAC será compuesto de: Los padres serán elegidos por la mayoría de votos de aquellos padres (de los niños EL alistados en el programa bilingüe en la escuela) presentes en la junta de elección anunciada. Directores, maestros, personal clasificado y ciudadanos que trabajan o residen en el área de servicio del distrito, nominados por los padres miembros del comité y elegidos por mayoría de votos de esos miembros presentes en la junta anunciada de elección del ELAC. B. La notificación de la junta de elección del ELAC será enviada a los padres de todos los estudiantes por lo menos una (1) semana por adelantado de la junta de elección. C. Los miembros del ELAC que representan a padres y/o otros miembros de la Comunidad no serán empleados de la escuela. Sección 2. Deberes normales de los miembros del ELAC

5 Será el deber de todos los miembros elegidos del ELAC el: A. Aceptar posiciones como miembros y/o oficiales de subcomités cuando sea asignado o elegido a menos que sea incapaz de realizar los deberes que tal membresía le exija. ARTÍCULO IV Oficiales del ELAC Sección 1. Los oficiales del ELAC serán presidente, vise presidente, y secretaria. Presidente. El presidente presidirá en todas las juntas del ELAC y puede firmar todas las cartas, informes, y otras comunicaciones del ELAC. Además, el presidente realizará todos los deberes de la oficina del presidente y los otros deberes tales como puedan ser asignados por el ELAC de tiempo a tiempo. Vise presidente. Los deberes del vise presidente serán representar al presidente en deberes asignados y sustituir para el presidente durante su ausencia. El vise presidente realizará los otros deberes tales como de tiempo a tiempo puedan ser asignados por el presidente o por el ELAC. Secretaria. La secretaria guardará las minutas de las juntas, regulares y especiales, del ELAC, guardará un registro de las direcciones y de los números de teléfono de cada miembro del ELAC que será proporcionado a la secretaria por los miembros en general, y hará todos los deberes como a partir de tiempo a tiempo puede ser asignado a la oficina por el presidente o por el ELAC. Sección 2. Elección de los oficiales y término de su oficina A. Los oficiales del ELAC serán elegidos anualmente y servirán a por un año hasta que un sucesor sea elegido. B. E. Si un oficial está ausente por más de 3 juntas, sin una excusa valida, el oficial presidiendo la junta declarará la posición vacante y se elegirá un nuevo oficial. ARTÍCULO V Juntas del ELAC Sección 1. Reuniones del ELAC El ELAC se juntará regularmente por lo menos una vez por cuarto en a las. Sección 2. Aviso de Juntas El aviso público de juntas regulares será dado por lo menos una (1) semana por adelantado de la junta. Cualquier cambio en la fecha, el tiempo, o la localización establecida se debe avisar especialmente. Todos los cambios en la junta serán publicados. Cualquier aviso será por escrito; indicará el día, la hora, y la localización de la junta; y será enviado a casa con el niño de los padres, entregado personalmente, o por correo a cada miembro del ELAC. Sección 3. Juntas Especiales

6 Las juntas especiales pueden ser convocadas por el presidente o por la mayoría de votos del ELAC. Se darán noticias de juntas especiales por lo menos 48 horas por adelantado de la junta especial y serán entregadas por escrito, personalmente o por correo a cada miembro del ELAC. Sección 4. Lugar de Juntas Sección 5. Quórum El ELAC tendrá sus juntas mensuales regulares y sus juntas especiales en una facilidad proporcionada por la escuela y fácilmente accesible a todos los miembros del público, incluyendo personas incapacitadas. Se requerirá la presencia de una mayoría simple de miembros total, o suplentes elegidos que sirven por los miembros regulares para constituir un quórum necesario para la transacción del negocio del ELAC. Sección 8. Juntas Abiertas al Público Todas las juntas regulares y especiales del ELAC y de sus comités regulares y especiales siempre estarán abiertas al público. ARTÍCULO VI ENMIENDAS Sección 1. Estos reglamentos se pueden enmendar en cualquier junta, por dos-tercios de mayoría de votos de un quórum de un quórum que está presente. Sección 2. Las juntas serán gobernadas por estos reglamentos, y cualquier conflicto será solucionado por las Reglas de Orden de Roberto. Un parlamentario será elegido por la mayoría en la primera junta del nuevo ELAC elegido.
