1 HPD Immigration Policy Questions & Answers 1. Is it true that immigrants should now be afraid of reporting any crimes to HPD because if they do, they may be turned over to Immigration and Customs Enforcement (ICE)? No. We hope and encourage immigrant communities to continue to call us when they need assistance from the police. Immigrants who are victims of crime or have information regarding criminal activity should contact the police. Individuals should not fear that HPD will call immigration agents. HPD will only contact ICE when a person is confirmed to have a deportation warrant or a notice from ICE that they are a previously deported felon. In addition, ICE currently has policies and/or privileges in place that may allow a victim or witness to a crime, to obtain a U-Visa based on cooperation with an on-going law enforcement investigation. 2. Will HPD officers detain me simply because they think I am here illegally? No. HPD officers are not authorized to arrest or detain a person solely on a belief that the person is in the country illegally. Officers are authorized to arrest and detain a person whom they have a reasonable suspicion to believe has committed a criminal violation. 3. Is it true that HPD officers are going to ask all people they encounter for proof of legal residence/status? No. Houston police officers are prohibited from inquiring into a person s citizenship status simply to determine if the person is in the country illegally. Furthermore, HPD officers are not authorized to arrest or detain a person solely on a belief that the person is in the country illegally. 4. Is it true that HPD will arrest any foreign person? No. Officers are not authorized to detain or arrest a person solely on the basis of their nationality or ethnicity. Officers are authorized to arrest and detain a person whom they have a reasonable suspicion to believe has committed a criminal violation. 5. Is it true that HPD will run a background check on all people they encounter? No. HPD officers do not run a background check on all people they encounter. HPD officers do have the discretion to check the wanted status of all persons who are ticketed, arrested, jailed, or legally detained. 1

2 6. Is it true that HPD will call ICE on all people they encounter? No. Jail personnel will ONLY contact ICE if during a check of a person s wanted status, he/she is found to have a deportation warrant, a notice that they are a previously deported felon, or have other criminal warrants issued by ICE. HPD may also contact ICE if an investigation requires the assistance of ICE agents. 7. If I am arrested or taken to jail by HPD will ICE be called? All individuals arrested and booked at one of the two City of Houston jails will be run through the Secure Communities Program. ICE will notify HPD if a detainer is placed on a subject that has been arrested by HPD. ICE officials are allowed full access to HPD jail facilities. 8. If I am driving without a license and get stopped by HPD, will I get arrested? Will ICE be called? If a person drives without a license and is stopped by HPD, that person will be asked to provide valid identification. If the person cannot provide valid identification and the HPD officer cannot verify their identity, the person will be taken to jail for driving without a license so the person can be positively identified and fingerprinted. After having fingerprinted the person, the information will be run through the Secure Communities Program. 9. What forms of identification will HPD officers accept? Officers will accept driver s licenses and identification cards issued by any state of the United States of America. Also, the officers will accept most other forms of government ID such as a military ID, passport, etc. Additionally, officers are advised that a Matricula Consular card issued by the Mexican Consulate is presumed valid unless the totality of the circumstances calls the validity of the card into question. 10. If I am a suspect in a crime or an HPD officer believes that I may be involved in a criminal episode, can he/she ask me for identification? Yes. The officer is authorized to ask any individual for identification whom the officer has a reasonable suspicion to believe has committed or was involved in criminal activity. 11. If I do not have identification, can I be arrested? It is not against the law to not possess a form of identification on your person, as long as you are not driving a motor vehicle. However, if you have committed a criminal offense, traffic violation, and cannot provide an identification for the police officer, and the officer cannot verify your identity, the officer has the discretion to take the individual into custody for the criminal violation so that the person can be identified, and fingerprinted in order to determine the person s true identify. You will not be arrested for not having proper identification, unless you are suspected of having committed a crime. For safety reasons, the HPD officer needs to know whom he/she is interacting with, with respect to the investigation. 2

3 12. If the officer stops me for a minor traffic violation, will I be arrested? A police officer has the discretion to arrest a person who does not have a valid form of identification and whose identify cannot be verified. You will be arrested if it is confirmed that you have a Municipal Warrant, NCIC, and/or SETCIC warrant hit. Officers will check the wanted status of all persons arrested, ticketed or jailed. Officers also have the discretion to check the wanted status of anyone legally detained, including persons detained for minor traffic violations. 13. If the officer stops me for a minor traffic violation, will I be deported? If the officer s computer check verifies that you have a deportation warrant or a notice that you are a previously deported felon, the officer will take you to a city jail facility and ICE will be contacted accordingly. The Department of Homeland Security (ICE) will determine whether or not someone isremoved from the country. HPD does not make decisions in regards to removing people from the country. 14. If I am found to have city warrants (like unpaid traffic tickets), will I eventually be deported? If you have city warrants you are subject to arrest for those warrants. If during such arrest, you are also confirmed to have a deportation warrant, a notice that you are a previously deported felon or any other criminal warrant with ICE, the officer will take you to a city jail and ICE will be contacted. Only ICE will make decisions to remove someone from the country. As previously stated, if you are arrested and booked at any of the two local jails (HPD), you will be run through the Secure Communities Program. 15. If I am an illegal immigrant in possession of a firearm, can I be arrested and deported? Yes. Illegal immigrants are prohibited from possessing a firearm and are subject to arrest by HPD officers. If during such arrest, you are also confirmed to have a deportation warrant or are a previously deported felon, the officer will take you to a city jail and your information obtained through AFIS, will be run through the Secure Communities Program. Only ICE will make decisions to remove individuals from the country. Should you return to the U.S. after being convicted of the felony of being in possession of a firearm, the federal authorities can prosecute you for illegal re-entry, a criminal offense punishable of up to 20 years in prison. 3

4 Secure Communities Questions & Answers 1) What is Secure Communities & how does HPD participate in this program? Secure Communities is an existing federal information-sharing partnership between ICE, HPD, and the FBI that assists in identifying criminal aliens without imposing additional requirements on local and state law enforcement. Local jurisdictions such as HPD share the digital fingerprints of prisoners booked at the two City of Houston jail facilities with the FBI to determine if they have a criminal record and/or are wanted in another jurisdiction. The FBI then automatically sends this information to ICE to check against their immigration databases. 2) Who may be run through the Secure Communities program by HPD? Any individual that has been arrested by HPD for any crime and booked at one of the two city jails will be run through the Secure Communities Program regardless of their citizenship status. 3) Will all individuals arrested by HPD and run through the Secure Communities Program be removed from the U.S. if they are found to be unlawfully present in the U.S.? ICE may take enforcement action by removing individuals who present the most significant threats to public safety. Threat to public safety is determined by examining the severity of crime, criminal history, repeat violation of immigration laws as well as other factors. Although ICE has indicated that they will remove from the country those individuals who commit the most serious offenses, ICE does not guarantee that someone who commits a minor offense will not be removed from the country. 4) Does HPD make the decision to remove someone from the country? No. HPD does not make any decisions and is not involved in the process or decision-making of removing people from the country. ONLY the federal government will make the decision on any immigration enforcement action. 5) Are HPD officers allowed to ask about someone s citizenship status under this new Secure Communities program? The Houston Police Department s General Order (500-05) created in 1992 prohibits police officers from inquiring into a person s citizenship status simply to determine if the person is in the country illegally. HPD officers are not authorized to arrest or detain a person solely on a belief that the person is in the country illegally. Officers are authorized to arrest and detain persons who they have a reasonable suspicion to believe have committed a criminal violation. Once a person has been arrested and taken to a jail facility, HPD jail personnel will then run the individual through the Secure Communities Program. 4

Me detendran los oficiales de la policía de Houston (HPD) simplemente por pensar que estoy aquí ilegalmente? NO. Los oficiales de la policía de Houston no tienen autorizacion de arrestar o detener a las personas simplemente por sospechar que esten en el país ilegalmente. Los oficiales de la policía estan autorizados a arrestar y detener a personas que ellos sospechen que han cometido un delito. 3. Los oficiales de la policía de Houston requieren que toda persona muestre algun comprobante de su estatus legal o residencial? NO. Oficiales de la policia de Houston les han prohibido preguntar a las personas sobre su estatus legal o cuidadania, si su unico proposito es determinar si residen en el pais legalmente. Los oficiales de la policia de Houston no tienen autorizacion de arrestar o detener a las personas simplemente por sospechar que residen en el pais ilegalmente. 4. Es verdad que los oficiales de la policía de Houston van a arrestar a cualquier extranjero? NO. 6 5. Es verdad que los oficiales de la policía de Houston investigarán el historial criminal de toda persona con la que se haya tenido contacto? NO. Los oficiales de la policía de Houston no revisaran el historial criminal de todas las personas con las que hayan tenido contacto. Los oficiales de la policia de Houston poseen las discrecion de investigar el historial criminal y banco de datos de personas buscadas, o que hayan sido multados, arrestados, encarcelados, y detenidos legalmente. 6. Es verdad que la policía de Houston llamará a agentes federales de inmigración (ICE) cada vez que detenga/interrogue a una persona? NO. El personal de la carcel llamara al departamento de Inmigracion UNICAMENTE si durante la revision de historial criminal se descubre que la persona tiene una orden de arresto para ser deportado, que ha sido expulsado del pais previamente, o existe una orden de arresto por otros delitos y haya sido expedida por ICE. El departamento de la policia de Houston tambien se comunicara con el departamento de ICE si una investigacion requiere su asistencia. 7. Si soy arrestado y fichado en una de las dos carceles municipales, la Policia de Houston llamará al departamento de ICE? Toda persona arrestada y fichada en una de las dos carceles municipales sera investigada a travez del programa de Comunidades Seguras, sin importar su estatus migratorio o cuidadania. El departamento de Inmigracion (ICE) notificara a la policía de Houston si llega a expedir un detenedor a las personas arrestadas por la policia de Houston. Oficiales de ICE tienen acceso completo a las cárceles de la policía de Houston y a los archivos de las personas ahí detenidas. 8. Si manejo sin licencia para conducir y soy detenido por la policía de Houston, seré arrestado? Llamarán al departamento de ICE? Si usted maneja sin licencia para conducir y es detenido por la policía, el oficial de policia le pedira que muestre una forma de identificación. Si usted no tiene una identificación válida y el oficial de policía no puede verificar su identidad, será llevado a la cárcel de la ciudad por manejar sin licencia y será identificado a travez de nuestro sistema de huellas digitales. Despues de haberlo identificado a travez de nuestro sistema de huellas digitales, la informacion adquirida por la policia de Houston sera automaticamente compartida con el departamento del FBI e Inmigracion (ICE) a travez del programa de Comunidades Seguras. 9. Que tipo de identificación será aceptada por la policía de Houston? Los oficiales de la policía de Houston aceptarán licencias para conducir y tarjetas de identidad (ID) de cualquier estado en los Estados Unidos de América. Los oficiales tambien aceptarán la mayoría de las identificaciónes expedidas por el gobierno federal como identificación del ejercito, pasaportes de diferentes paises, etc. Adicionalmente, se le ha notificado a los oficiales de la policía que la matrícula consular aprovada por el gobierno Mexicano, es un documento válido; al menos que el oficial de policía tenga una razón para poner en duda la autenticidad de la matrícula consular que se le presenta. 6

7 10. Si una persona es sospechosa de haber cometido o colaborado en un crímen, puéde el official preguntarle por identificación? SI. El oficial de la policía tiene autorizacion para preguntar por la identificación a toda persona quien el policia piense que ha cometido un crímen o sea parte de una actividad criminal. 11. Puedo ser arrestado por no tener identificación (ID)? No. No es contra la ley no poseer un tipo de identificacion, almenos que haya estado conduciendo un vehiculo o haya cometido algun delito. Si usted ha cometido un crímen o una violación de tráfico y no tiene identificación para presentarle al oficial de la policia y el o ella no puede verificar su identidad, el oficial tiene la autoridad de arrestarlo por violación de ley. Una vez arrestado se le llevará a la cárcel para ser identificado y tomar sus huellas dígitales a travez de AFIS (Sistema Automatizado de Identificacion de Huellas Dígitales). 12. Si un oficial me detiene por una violación menor de transito, podria ser arrestado? Los oficiales de la policia tienen la discreción de arrestar a las personas si no pueden verificar su identidad. Usted será arrestado si se confirma por medio del NCIC (Centro Nacional de Información del Crímen) o por SETCIC (Centro del Sur de Texas de Información del Crímen) que usted tiene una orden de arresto. Oficiales de la policia revisarán el historial criminal de personas que reciban multas, sean arrestados o encárcelados. Oficiales de la policia támbien tienen la discreción de revisar si la persona que ellos han detenido legalmente (incluyendo a personas detenidas por violaciones menores de tráfico) es buscada por alguna otra razón. 13. Si un oficial me detiene por una violación menor de tráfico, podria ser deportado? Si el oficial verifica durante el curso de la investigacion que usted tiene una orden de arresto por deportación o ha cometido una felonía y ha sido previamente deportado, el oficial lo llevará a la cárcel y los empleados de la cárcel se comunicaran con ICE. Los oficiales de la policía de Houston no haran decisiones relacionadas a la expulsion de personas del pais. 14. Si tengo órden de arresto por una violación municipal (como una multa que no he pagado) puedo ser deportado? Si usted tiéne una orden de arresto por no pagar una multa, usted puéde ser arrestado en cualquier momento. Si durante este proceso se comprueba que usted tiéne una orden de arresto por deportación, que ha sido previamente expulsado después de cometer una felonía o crímen mayor o tiéne orden de arresto en el historial de ICE por cualquier otro crímen cometido; el oficial lo llevará a una cárcel de la ciudad y ahí notificarán a ICE. Solamente ICE toma decisiones relacionadas a la expulsion de personas del pais. 15. Si soy una persona ilegal en pocesión de un arma de fuego, puedo ser arrestado y deportado? SI! Personas indocumentadas (ilegales) se les prohibe poseer armas de fuego y pueden ser arrestados por oficiales de la policía de Houston. Si durante este arresto, se confirma que usted tiéne una orden de arresto por deportación, o que ha sdo previamente expulsado después de cometer una felonía; el oficial lo llevará a la cárcel de la ciudad y ahí notificarán a ICE. Solamente ICE toma decisiones relacionadas a la expulsion de personas del pais. 7

8 Preguntas y Respuestas con respecto al programa de Comunidades Seguras 1. Que es el programa de Comunidades Seguras y cual es el papel de la policia de Houston como participante de este programa? El programa de Comunidades Seguras es un esfuerzo colaborativo entre agencias policiacas locales, estatales, y federales que facilita la identificacion de personas que hayan cometidos delitos y que esten residiendo en el pais ilegalmente. Este esfuerzo comun no afecta al personal o el trabajo de las agencias policiacas porque es llevado acabo a travez de un sistema computacional donde las agencias comparten informacion sobre las personas que son arrestadas. El programa de Comunidades Seguras UNICAMENTE afectara a personas que hayan sido arrestadas por cualquier delito. Bajo el programa de Comunidades Seguras la persona primero seria arrestada por el delito, fichada en una de las dos carceles municipales, y despues seria identificada a traves de nuestro sistema de huellas digitales (Sistema Automatizado de Identificacion de Huellas Dígitales). La informacion de la persona identificada posteriormente sera revisada contra los bancos de datos locales y estatales para obtener el historial criminal. Esta informacion seria compartida y enviada a la agencia del FBI y Departamento de Inmigracion para revisar el historial criminal a nivel federal y el estatus migratorio de la persona. 2. Quienes seran investigados a travez del programa de Comunidades Seguras? Toda persona arrestada por cualquier delito por la policia de Houston y fichada en una de las dos carceles municipales, sera revisada a travez del programa de Comunidades Seguras, sin importar el estatus migratorio o cuidadania de la persona. 3. Seran deportados quienes sean arrestados y procesados por la policia de Houston a travez del programa de Comunidades Seguras? El departamento de Inmigracion (ICE) sera la unica agencia policiaca federal que iniciara y llevara acabo el proceso para expulsar del pais a personas. El criterio que sera utilizado para expulsar a personas del pais depende de el nivel de amenaza que el sujeto pueda ser a la comunidad. El nivel de amenaza es determinado por la gravedad del delito por el cual fue arrestado, el historial criminal, la repeticion de violacion de leyes migratorias, y otros factores. El gobierno federal (ICE) nos ha indicado que ellos detendran y expulsaran a individuos que hayan cometido los delitos mas graves, sin embargo, no garantiza que alguien que haya cometido un delito menor, no sea expulsado. 4. La decision para expulsar/deportar a personas del pais es hecha por la policia de Houston? No. El departamento de policia de Houston NO HARA ninguna decision o estara involucrado en el proceso incicial que se require para expulsar a personas del pais. UNICAMENTE el gobierno federal (ICE) hara decisiones relacionadas a la expulsion de personas del pais. 8

9 5. Tendran autorizacion los oficiales de policia del departamento de Houston para preguntar a las personas sobre su estatus migratorio o cuidadania, bajo el programa de Comunidades Seguras? NO. La Orden General del departamento de policia de Houston prohibe a oficiales de policia preguntar a las personas sobre su estatus legal o cuidadania, si su unico proposito es determinar si residen en el pais legalmente. Los oficiales de la policia de Houston no tienen autorizacion de arrestar o detener a personas simplemente por sospechar que reside en el pais ilegalmente. Los oficiales de policia si tienen autorizacion de arrestar y detener a personas quien ellos sospechen que han cometido un delito. Como anteriormente se a mencionado, si la persona es arrestada y fichada en una de las dos carceles municipales, la informacion obtenida a travez de nuestro sistema de huellas digitales, sera compartida y enviada a las agencias policiacas a nivel local, estatal, y federal por medio del programa de Comunidades Seguras. 9
