7 CITY OF SACRAMENTO MEASURE B B Shall the Sacramento City Council, acting through the Sacramento Streetcar Community Facilities District No , City of Sacramento,, State of California (the CFD ), be authorized to incur debt with a principal amount not exceeding $38,000,000 and to annually levy a special tax within the CFD to finance the acquisition, improvement, and construction of certain public facilities, and shall the appropriations limit for the CFD during fiscal year be established in the amount of $38,000,000, all as described in the Resolution No and Resolution No , both adopted on February 24, 2015? ENGLISH IMPARTIAL ANALYSIS OF MEASURE B Prepared by the Sacramento City Attorney The Sacramento City Council has called this special mailed-ballot election. The Mello-Roos Community Facilities Act of 1982 (the Act ) authorizes the City to establish community facilities districts as a means of financing certain public facilities and services. On February 24, 2015, the City Council adopted Resolution No forming the Sacramento Streetcar Community Facilities District No (the Resolution of Formation ) and Resolution No deeming it necessary to incur bonded indebtedness (the Bond Resolution ). The district s purpose is to assist in financing a proposed streetcar project that is partly within the district's boundaries, as set forth in the Resolution of Formation. The district is within the City's downtown and midtown areas from the Sacramento River on the west to 22 nd Street on the east, with northern and southern boundaries drawn generally within three blocks of the proposed streetcar line. Approval of the ballot question would authorize the City Council to do the following: 1. To levy a special tax on every non-exempt parcel within the district, with the special-tax revenues used to pay principal and interest on bonds issued to finance the streetcar project or to pay directly for authorized district facilities. The special-tax rate would be set according to the Rate, Method of Apportionment, and Manner of Collection of Special Tax (the RMA ) that was adopted as part of the Resolution of Formation. The special-tax rate for each parcel would be based upon the parcel's location within one of four tax zones and its status as developed or undeveloped and, if developed, upon its use (e.g., residential, non-residential, mixed-use). The zones are drawn based on distance from the proposed streetcar line; zones closer to the line have higher special-tax rates than zones farther out. The special tax could not be levied after 40 years (fiscal year ). The special-tax revenues would be used to acquire, improve, and construct facilities for the streetcar project, such as real-property interests, tracks, vehicles, stations, signalization, landscaping, and infrastructure. The revenues would not be used for operations. 2. To incur bonded indebtedness through the district, up to a principal amount of $38 million, as set forth in the Bond Resolution. 3. To establish the district's appropriation limit for fiscal year at $38 million; this limit would be subject to annual adjustment as provided by the California Constitution. Approval requires a two-thirds majority of the votes cast. A yes vote is in favor of approval. A no vote is against approval. James C. Sanchez City Attorney FULL TEXT OF MEASURE B Sacramento Streetcar Project Description The Downtown / Riverfront Streetcar project is 3.3-mile line that will extend from the Midtown entertainment-and-retail district in the City of Sacramento to the West Sacramento Civic Center. Destinations connected by the line include Raley Field, the Sacramento Valley Station in the Railyards Specific Plan area, the planned terminus of the California High- Speed Rail system, the new Downtown Entertainment and Sports Center, the historic Memorial Auditorium, the Sacramento Community Center Theater, the California State Capitol, and the Sacramento Convention Center. The streetcars will stop approximately every three blocks. Ballot Type 001 Page 5

8 Project Details Vehicle Type: Modern Electric Streetcar Route Length: 3.3 Miles Capital Cost: $150 million Streetcar Route within the City of Sacramento Sacramento Streetcar Proposed Community Facilities District The Sacramento Streetcar Community Facilities District No (the CFD ) is proposed to fund approximately $30 million of the total capital cost of the streetcar project. The types of facilities to be financed by the CFD include tracks, streetcar vehicles, streetcar stations and platforms, related sidewalk infrastructure, structural and streetscape improvements, relocation or installation of above- and below-ground utilities, utility-access points, street paving, drainage, curb and gutter modifications and improvements, maintenance facilities, facilities for providing electricity to the system (including overhead wires and utility substations) and related infrastructure, traffic signalization and related systems, signage, wayfinding and lighting and landscaping related thereto, electronic and mechanical systems and programming therefor, and land rights-of-way and easements necessary for any of these facilities. In addition, the CFD may finance project enhancements or increases in project scope beyond what was submitted in the funding application to the Federal Transportation Administration on September 10, 2014, so long as the City Council and the board of directors of the nonprofit organization contracted to operate the streetcar project has reviewed and approved the financing of such enhancements or increases. 9 Sacramento Streetcar CFD Boundary Map ENGLISH ARGUMENT IN FAVOR OF MEASURE B Vote Yes on Measure B to benefit all our neighborhoods by improving mobility between midtown, downtown, and West Sacramento with an affordable transit system that is authentically Sacramento. Vote Yes on Measure B to keep transit affordable for all Sacramentans. The Sacramento streetcar plan calls for inexpensive fares and will allow existing transit pass holders to ride for no additional cost. A Yes vote on Measure B will simplify driving and parking downtown, saving money. Vote Yes on Measure B to help clean our air and reduce traffic congestion in our neighborhoods. The streetcar will connect to the light rail and bus system and allow easy connections to Amtrak, and eventually the airport. Residential properties in the district will pay less than 1% of the cost for this project with 99% of the costs paid by the federal government, the State of California, the City of Sacramento, the City of West Sacramento, the, and commercial property owners. Renters will pay nothing under Measure B. Seniors and residents living in affordable housing will pay nothing under Measure B. The project is a great deal for the people of Sacramento. Vote Yes on Measure B to improve our economy. Streetcars create a vibrant local economy, which means more small businesses and more jobs in downtown and midtown. The streetcar project will help create 12,000 jobs and $2.5 billion in economic development over 20 years. Streetcars will provide an inexpensive, safe, and fun way to get around Sacramento. Measure B will allow seniors, students, visitors, workers, and central city residents to go car-free. Streetcars are part of Sacramento's legacy and it's time to bring them back. No modern streetcar has revitalized any area unless accompanied by substantial subsidies to developers - which Sacramento cannot afford. Rents will rise to cover the new tax. Landlords will pass tax increases onto tenants, both commercial and residential. Streetcars won t improve parking. Motorists using the Streetcar still have to park. Drivers from outside the district will use your on-street parking spaces. The Streetcar won t improve mobility. Streetcars slow down cars, trucks, and buses, creating delays and congestion. Its proposed route is already served by public transit and is so circular and infrequent few people will use it. Streetcars won t clean air. The traffic congestion they cause increases pollution. No matter the accidents, delays, congestion and operating losses, Sacramento will be unable to stop operating the Streetcar once it is built, because Sacramento can t afford to refund the $75,000,000 federal construction grant. Proponents themselves acknowledge the Streetcar Project will produce annual losses in the millions. These losses will be made up by: (a) Cutting core City services like police, fire/ambulance service, parks and street repairs; and/or (b) Cutting Regional Transit's existing bus and light rail services which actually reduce pollution, relieve traffic congestion and permit folks of modest means to get to work and school. Winger s/julian Camacho s/sally Lorber s/leilani Fay ARGUMENT AGAINST MEASURE B Six Reasons to vote NO on the Streetcar Tax: (1) The streetcar district tax will pay only for construction. It will cost district property owners $90 million over 30 years, and will be passed on in commercial and residential rent hikes to tenants. (2) The streetcar project will operate at an enormous annual loss. Ticket sales are expected to cover about 20% of cost of operation; the other 80% will require a subsidy. The shortfall will likely come from the City's General Fund, reducing local services such as parks, bike lanes, street repairs, the homeless, and police. (3) Are you willing to park several blocks from your home to provide arena parking solutions? With arena events annually, look for an invasion of out-of-town drivers. Streetcars will transport arena patrons to and from cheap parking in nearby neighborhoods. The result: circling traffic and a severe loss of parking for residents, their visitors and businesses. (4) The streetcar project is wasteful transit duplication. It runs on, or near, the same Streets served by existing light rail and buses. It will worsen mobility for pedestrians and those using the existing public transit system. Tracks add danger to bicyclists. Ballot Type 001 Page 8

11 (5) The project worsens traffic by adding slow-moving, frequent-stopping streetcars. These will create delays at intersections and to-and-from I-5, especially on the 3 rd Street route that crosses L, J, and I Streets. (6) Politicians hype the streetcar as a catalyst for development. However, development is already happening on K, R and 16 th Streets and other parts of the Central City. Why squander scarce City resources on an unnecessary project? The streetcar project is essentially an amusement park ride rather than an important transit improvement. Vote NO on The Streetcar Tax, Measure B. Residential property owners are only being asked to pay for less than 1% of the construction costs. Senior housing and affordable housing pay nothing. Commercial property owners and the government will pay 99% of the costs to build the system. Residents will get the benefit of the streetcar without having to pay additional funds for operations. The cost to operate the streetcar will be paid through affordable fares, projected to be $1 to ride for two hours, advertising revenue, the cities of Sacramento and West Sacramento and Regional Transit. Streetcars will improve mobility of residents, providing easier access to pharmacies, doctors offices, grocery stores and other essential services. Streetcars will improve Sacramento s overall transit system, which is why Regional Transit, SACOG, the Sacramento Air District, Friends of Light Rail and others support the project. A YES vote means you want less traffic in Downtown and Midtown. Streetcars will greatly reduce short car trips and make it possible to be car free for those who live in the Central City. ANÁLISIS IMPARCIAL DE LA MEDIDA B Elaborado por el Abogado Municipal de Sacramento El Ayuntamiento de Sacramento ha convocado esta elección especial de boletas electorales por correo. La Ley Mello-Roos sobre Instalaciones de la Comunidad de 1982 (la Ley ) autoriza a la Ciudad a establecer distritos de las instalaciones comunitarias como medio para financiar algunos servicios e instalaciones públicos. El 24 de febrero de 2015, el Ayuntamiento adoptó la Resolución N.º , con la que se creó el Distrito de Instalaciones Comunitarias del Tranvía de Sacramento N.º (la Resolución de Creación ) y la Resolución N.º , en la que se estimaba que era necesario contraer una deuda en bonos (la Resolución de los Bonos ). El objetivo del distrito es ayudar a financiar un proyecto propuesto de tranvía que se encuentra parcialmente dentro de los límites del distrito, conforme a lo dispuesto en la Resolución de Creación. El distrito está dentro de las áreas céntricas de la ciudad del Río Sacramento al oeste a la Calle 22 al este, y los límites al norte y al sur generalmente se marcan a tres cuadras de donde se propone que pase el tranvía. La aprobación de la pregunta de la boleta electoral autorizaría al Ayuntamiento a hacer lo siguiente: 1. Recaudar un impuesto especial en todas las parcelas no exentas del distrito, y que los ingresos que represente el impuesto especial se usen para pagar el capital y los intereses en bonos que se emitan para financiar el proyecto de tranvía o para pagar directamente las instalaciones del distrito autorizadas. La tasa del impuesto especial se establecerá de conformidad con la Tasa, el Método de Distribución y la Forma de Recaudación del Impuesto Especial (la RMA ), que se adoptó como parte de la Resolución de Creación. La tasa del impuesto especial de cada parcela se basará en la ubicación de la parcela dentro de una de las cuatro zonas tributarias y su calidad de urbanizada o no urbanizada y, si está urbanizada, según su tipo de uso (por ejemplo, residencial, no residencial, uso mixto). Las zonas se delimitan según la distancia a la que estén del recorrido propuesto del tranvía; las tasas de las zonas más cercanas al recorrido serán más elevadas que de las zonas más alejadas. No se podrá recaudar el impuesto especial después de 40 años (año fiscal ). Los ingresos por el impuesto especial se usarán para adquirir, mejorar y construir instalaciones para el proyecto del tranvía, como los intereses de bienes inmuebles, las vías, los vehículos, las estaciones, la señalización, el diseño y la infraestructura. Los ingresos no se usarán para ponerlo en funcionamiento. 2. Contraer una deuda en bonos a través del distrito, por un capital de hasta $38 millones, según lo establecido en la Resolución de los Bonos. 3. Establecer el límite de apropiación del distrito para el año fiscal en $38 millones; este límite estará sujeto a un ajuste anual de conformidad con la Constitución de California. Para que se apruebe, es necesaria una mayoría de dos tercios de los votos emitidos. Los votos sí están a favor de la aprobación. Los votos no están en contra de la aprobación. ESPAÑOL James C. Sanchez Abogado Municipal TEXTO COMPLETO DE LA MEDIDA B Tranvía de Sacramento Descripción del Proyecto El proyecto de Tranvía Downtown / Riverfront tiene un recorrido de 3.3 millas que pasará por el distrito con actividad cultural y comercial de Midtown de la Ciudad de Sacramento y llegará al Centro Cívico de West Sacramento. Los lugares que quedarán comunicados gracias a este recorrido son el Raley Field, la estación Sacramento Valley del área del Plan Específico de Terminales Ferroviarias, la terminal planeada del sistema de Vías de Alta Velocidad de California, el Centro Deportivo y de Entretenimiento del Centro de la Ciudad, el histórico Memorial Auditorium, el Sacramento Community Center Theater, la sede del Congreso Estatal de California y el Sacramento Convention Center. 18 Detalles del Proyecto Tipo de Vehículo: Tranvía Eléctrico y Moderno Distancia del Recorrido: 3.3 Millas Coste Capital: $150 millones Recorrido del Tranvía en la Ciudad de Sacramento Tranvía de Sacramento Distrito de Instalaciones Comunitarias Propuesto Se propone que el Distrito de Instalaciones Comunitarias del Tranvía de Sacramento N.º (el CFD ) financie aproximadamente $30 millones del total del coste capital del proyecto del tranvía. Los tipos de instalaciones que el CFD debe financiar son las vías, los vehículos tranvía, las estaciones y las plataformas de tranvía, la infraestructura peatonal correspondiente, las mejoras estructurales y del paisaje urbano, la reubicación o instalación de los servicios públicos bajo el suelo y sobre el suelo, los puntos de acceso a los servicios públicos, la pavimentación de las calles, el drenaje, la modificación y mejora de los bordillos y las alcantarillas, las instalaciones de mantenimiento, las instalaciones necesarias para proporcionar energía eléctrica al sistema (incluidos los cables del techo y las subestaciones de servicios) y la infraestructura correspondiente, la señalización de tránsito y los sistemas relacionados, los letreros, las instrucciones gráficas de ubicación, la iluminación y el diseño correspondientes, los sistemas electrónicos y mecánicos y la programación de éstos, y los derechos de paso y usufructo sobre el terreno necesarios para el desarrollo de cualquiera de estas instalaciones, entre otros. Además, el CFD puede financiar mejoras al proyecto o ampliaciones en el alcance de éste además de las que se plantearon en la solicitud de financiamiento presentada ante la Dirección de Transporte Federal el 10 de septiembre de 2014, siempre y cuando el Ayuntamiento y la junta directiva de la organización no lucrativa que fue contratada para llevar a cabo el proyecto de tranvía haya revisado y aprobado el financiamiento de dichas mejoras o ampliaciones. 19 Mapa de los Límites del CFD del Tranvía de Sacramento ESPAÑOL ARGUMENTO A FAVOR DE LA MEDIDA B Vote Sí a la Medida B para que todos nuestros vecindarios se beneficien de las mejoras a la movilidad entre las áreas céntricas y West Sacramento, gracias a un sistema de transporte público que sea genuinamente de Sacramento. Vote Sí a la Medida B para que el transporte público siga siendo económico para toda la gente de Sacramento. El plan del tranvía de Sacramento requiere tarifas económicas y permite que las personas que ya tengan una tarjeta de transporte público usen el tranvía sin costo adicional. Un voto Sí a la Medida B permitirá que sea fácil manejar y estacionarse en el centro, y ahorrar dinero. Vote Sí a la Medida B para ayudar a limpiar nuestro aire y reducir la congestión vehicular en nuestros vecindarios. El tranvía comunicará el tren ligero y el sistema de autobuses, y permitirá la conexión práctica a Amtrak y, a largo plazo, con el aeropuerto. Las propiedades residenciales en este distrito pagarán menos del 1% del costo de este proyecto, pues el 99% de los costos será pagado por el gobierno federal, el Estado de California, la Ciudad de Sacramento, la Ciudad de West Sacramento, el Condado de Sacramento y los propietarios de establecimientos comerciales. Los arrendatarios no pagarán nada con la Medida B. Los adultos de la tercera edad y los habitantes que vivan en viviendas económicas no pagarán nada con la Medida B. El proyecto le conviene mucho a la gente de Sacramento. Vote Sí a la Medida B para mejorar nuestra economía. Los tranvías crean una economía local dinámica, lo cual significa más pequeñas empresas y más empleos en el centro de la ciudad y sus alrededores. 20 Los tranvías proporcionarán una manera económica, segura y divertida de recorrer Sacramento. Ningún tranvía moderno ha revitalizado algún área a menos que esté acompañado de subsidios sustanciales para los desarrolladores - lo cual Sacramento no puede costear. Las rentas aumentarán para cubrir el nuevo impuesto. Los propietarios harán que los arrendatarios, tanto comerciales como residenciales, cubran los aumentos en los impuestos. Los tranvías no resolverán los problemas para estacionarse. Los automovilistas que usen el Tranvía tendrán que estacionarse de todas maneras. Los conductores ajenos al distrito usarán sus espacios de estacionamiento en las calles. El Tranvía no mejorará la movilidad. Los tranvías hacen que los autos, los camiones y los autobuses avancen con mayor lentitud y causan retrasos y congestionamientos. Su ruta propuesta ya está cubierta por el transporte público y es tan circular e infrecuente que poca gente la usará. Los tranvías no limpian el aire. La congestión de tránsito que causan aumenta la contaminación. Sin importar los accidentes, los retrasos, la congestión y las pérdidas que represente su funcionamiento, Sacramento no podrá detener el funcionamiento del Tranvía una vez que esté construido, debido a que no podrá reembolsar los $75,000,000 de la subvención federal para la construcción. Incluso sus partidarios reconocen que el Proyecto del Tranvía producirá pérdidas millonarias cada año. Estas pérdidas se compensarán al: (a) Hacer recortes en los servicios básicos de la Ciudad como la policía, el servicio de bomberos/ambulancias, las reparaciones de parques y calles; y/o (b) Hacer recortes en los servicios de autobuses y tren ligero del Transporte Público Regional que ya existen, los cuales sí reducen la contaminación, disminuyen las congestiones de tránsito y permiten a los ciudadanos de bajos recursos ir al trabajo y a la escuela. Queremos sacrificar los servicios actuales de la Ciudad, la seguridad pública y los servicios de transporte público para dar la vuelta en un transporte sacado de un parque de atracciones? A los dueños de propiedades en el distrito les costará $90 millones a lo largo de 30 años, los cuales se reflejarán en aumentos en las rentas comerciales y residenciales para los arrendatarios.
