SCHOOL BASED MANAGEMENT (SBM) BY-LAWS Foshay Learning Center LAUSD/ESC-West ARTICLE ONE The name of the organization shall be the Foshay Learning Center School Based Management Council (SBM). ARTICLE TWO Composition: The council shall be composed of: 5 Parents/Community Members 1 Classified Staff Member 1 Student Representative 1 Principal 1 UTLA Chapter Chair 7 Teachers In addition there shall be alternates per each category. ARTICLE THREE Teacher members and alternates shall be elected yearly during the months of April or May. Elections will be coordinated by the facilitator and designees. The elected SBM council members will choose a facilitator through consensus. Attendance is expected at all meetings from both council members and alternates. If a member must be absent, he or she must notify the facilitator in advance. Council membership shall be terminated for any member with excessive absences. An absence shall be defined as missing three cumulative meetings during the school year. Meetings begin at 3:30. Any elected member may terminate his or her membership by submitting a written letter of resignation to the council facilitator. ARTICLE FOUR Term of office for all elected council members and the facilitator shall be one school year. ARTICLE FIVE At the first regularly scheduled meeting of the council for the new school year, the council shall decide and publish the meeting dates/times/location for all regular meetings during the school year. This will be posted on the Foshay Learning Center website and in the Parent Center. The regular meetings shall be chaired by the facilitator. All meeting of the council shall be open to stakeholders.
Stakeholders shall be allowed to speak on items on the agenda. Stakeholder speakers shall be limited to a period of three minutes. Non-agenda items will be addressed by stakeholders during public comment at the end of each meeting. During New Business members may address items not on the agenda. When setting the agenda for each meeting, the facilitator and the UTLA Chair shall set time limits per agenda item. These time limits may be extended by the will of the council. Revisions to the agenda should be made available to council members by the start of each meeting. The next meeting s agenda will be planned at the previous meeting during New Business. The items Public Comment and New Business are to be placed on each agenda. At the time discussion is initiated on an item, the facilitator must set a time limit for discussion. These time limits may be extended by consensus of the council. ARTICLE SIX All members including alternates shall be notified 72 hours prior to a meeting. An agenda plus the minutes of the previous meetings shall be posted to the school website in English and Spanish. The Spanish translation shall be the responsibility of the principal. ARTICLE SEVEN The attainment of consensus shall be a primary goal. All parties recognize that decisions made by consensus are the most effective in promoting cooperation and commitment to any policies established by the council. Three attempts/calls will be made to reach consensus per pending item. If consensus cannot be reached after the first call for consensus, further discussion/research will ensue. Only if consensus cannot be reached after the third attempt/call for consensus shall decisions be made by majority vote of the elected council members. The facilitator will vote to break the tie. No decision can be reached by consensus, not any vote taken unless a quorum is present. Nine (9) regular members or their alternates shall be a quorum. Meaningful consensus and decisions can be reached only if each speaker is allowed to speak uninterrupted and with the full attention of the council. If common courtesy does not allow this, it will be the duty of the facilitator to enforce speaking rules. ARTICLE EIGHT Committees shall be established by the council as is appropriate to carry out School Based Management (SBM) related to business. Council elects shall be delegated to oversee and/or chair a committee. ARTICLE NINE The council shall amend these By-laws as deemed necessary through consensus. Amended By-laws shall be made public to all stakeholders.

Concilio de la Mesa Directiva Local (SBM) Reglamentos Centro de Aprendizaje Foshay LAUSD/ESC-West ARTICULO UNO El nombre de la organización deberá ser El Concilio de la Mesa Directiva Local Centro de Aprendizaje Foshay. (SBM). Por sus siglas en Ingles. ARTICULO DOS Compostura: El concilio debe componerse de: 5 Padres/Miembros de la comunidad 1 Miembro del personal clasificado 1 Representante Estudiantil 1 Directora 1 Presidente de UTLA Unión de maestros 7 Maestros Además debe haber un suplente por cada categoría. ARTICULO TRES Maestros, miembros y suplentes deberán ser electos anualmente durante los mese de Abril o Mayo. Las elecciones deben de ser coordinadas por el facilitador y los de signatarios. Los miembros elegidos de SBM deberán elegir un facilitador por medio de un consenso. Se espera la asistencia en todas las reuniones de los dos miembros del Consejo y sus suplentes. Si un miembro tiene que estar ausente, él o ella deben notificar al facilitador por adelantado. La membrecía del Consejo deberá ser terminada para cualquier miembro con ausencias excesivas. Una ausencia se define como falta a tres reuniones acumuladas durante el año escolar. Las reuniones comienzan a las 3:30. Cualquier miembro electo puede terminar su membrecía mediante la presentación de una carta de renuncia por escrito al facilitador del consejo. ARTÍCULO CUATRO Duración del mandato de todos los miembros del consejo elegidos y el facilitador será de un año escolar. ARTÍCULO CINCO En la primera reunión ordinaria del Consejo para el nuevo año escolar, el Consejo decidirá y publicará las fechas de reuniones / horas / ubicación para todas las reuniones regulares durante el año escolar. Esta será publicada en la página web del Centro de
Aprendizaje Foshay y en el Centro de Padres. Las sesiones ordinarias serán presididas por el facilitador. Toda reunión del Consejo estará abierta a los interesados. A Las partes interesadas se les permite hablar sobre temas de la agenda. A las partes interesadas se les limitará a un período de tres minutos. Los artículos que no están en la agenda serán atendidos por los interesados durante los comentarios públicos al final de cada reunión. En la parte de nuevos negocios los miembros pueden tratar asuntos que no estaban en la agenda de la orden del día Al fijar la agenda de cada reunión, el facilitador y el Presidente de UTLA fijarán límites de tiempo por cada tema del programa. El límite de tiempo podrá ser extendido según la voluntad del consejo. La revisión del programa (agenda) debe de ponerse a disposición de los miembros del consejo al inicio de cada reunión. La agenda de la próxima reunión se planeó en la reunión anterior durante el tema de nuevos negocios. Los artículos de Comentarios Públicos y Nuevos Negocios se van a colocar en cada programa. En el momento de iniciar la discusión sobre un tema, el facilitador debe establecer un límite de tiempo para la discusión. Estos plazos podrán ser extendidos por consenso del Consejo. ARTÍCULO SEIS Todos los miembros, incluso los suplentes serán notificadas 72 horas antes de una reunión. Una agenda más las actas de las sesiones anteriores se publicarán en el sitio web de la escuela en inglés y español. La traducción al español será la responsabilidad del la directora. ARTÍCULO SIETE El logro del consenso será un objetivo primordial. Todas las partes reconocen que las decisiones tomadas por consenso son los más eficaces en la promoción de la cooperación y el compromiso con las políticas establecidas por el consejo. Se harán tres intentos / llamadas para llegar a un consenso por artículo pendiente. Si el consenso no puede ser alcanzado después de la primera convocatoria de consenso, discusión adicional / investigación se producirán. Sólo si el consenso no puede ser alcanzado después del intento / convocatoria de consenso tercero serán las decisiones sean tomadas por mayoría de votos de los concejales electos. El facilitador votar para deshacer el empate. Ninguna decisión puede tomarse por consenso, no habrá una votación a menos que haya quórum. Nueve (9) miembros titulares o sus suplentes se requerirán para tener un quórum. Consensos y decisiones significativas sólo se puede llevar a cabo si se permite que a cada portavoz hablar sin interrupciones y con toda la atención del Consejo. Si la cortesía
común no permite llegar a un acuerdo, será el deber del facilitador para hacer cumplir las reglas que debe seguir cualquier persona que toma la palabra. ARTÍCULO OCHO Comités serán establecidos por el Consejo que proceda para llevar a cabo la administración de los asuntos relacionados con la mesa directiva local (SBM). Consejo elegido serán delegados para supervisar al presidente del comité. ARTÍCULO NUEVE El Consejo deberá modificar los presentes Estatutos que se consideren necesarios a través de un consenso. Estatutos reformados se harán del dominio público de todos los interesados. ARTÍCULO DIEZ Estos Estatutos entrarán en vigor cuando sean aprobados por el consenso del consejo.
