Federal and state law and the California Education Code mandate that the District annually publish and disseminate nondiscrimination notices. This Memorandum replaces MEM , Required Nondiscrimination Notices , issued July 1, 2011, and MEM , Ordering and Distribution of Student Brochures - Title IX and Nondiscrimination and Section 504 and Students with Disabilities issued July 15, 2011 by the. It is issued annually as a reminder to schools and offices to publish and disseminate the required Nondiscrimination Statement, Sexual Harassment Policy, Title IX and Nondiscrimination student brochure, and Section 504 and Students with Disabilities student brochure as relevant to employees and students, and includes information about ordering Section 504 file folders to be used to file required Section 504 documentation in each eligible student s cumulative record. GUIDELINES: I. Distribution of Nondiscrimination Notices, Title IX and Nondiscrimination Student Brochures A. Posting of Nondiscrimination Notices The following publications must be posted in all schools and offices, including staff lounges, student government meeting rooms (secondary schools), the main administration building, or other prominent locations where notices are regularly posted regarding rules, regulations, procedures, or standards of conduct: MEM Page 1 of 4 August 13, 2012

Sexual Harassment Policy poster (attached) in English and Spanish to be duplicated as necessary 3. Title IX/Bullying Complaint Manager poster (attached) in English and Spanish to be duplicated as necessary B. Employees Copies of the District s Nondiscrimination Statement and the Sexual Harassment Policy (attached) are to be disseminated to each employee (both at schools and offices) on an annual basis. C. Students 1. All required nondiscrimination notices are provided in the Parent Student Handbook, which is to be distributed to every student during the first month of enrollment or at the time of initial enrollment. For information about or how to obtain copies of the Parent Student Handbook , refer to the memorandum issued annually by the Office of the Chief Operating Officer. 2. The District s written Nondiscrimination Statement and Sexual Harassment Policy must be presented to all students in ageappropriate language as part of any orientation program conducted for students at the beginning of the school year for each track/semester or summer session, as applicable. The presentation shall include information about how to report a complaint of discrimination or sexual harassment. 3. Elementary schools, at the discretion of administrative staff, may distribute the District s Students, Don t Let Others Bully or Harass You! brochure during presentations on sexual harassment to students at the beginning of each school year or at the time of initial enrollment. The brochure may be duplicated and is available on the District s website at eeco.lausd.net. 4. All secondary schools are required to distribute the District s Title IX and Nondiscrimination Students Know Your Rights brochure to every student at the beginning of each school year or at the time of initial enrollment. Distribution of Section 504 and Students with Disabilities Brochures and Related Documents/Forms A. Students All schools are required to distribute the District s Section 504 and Students with Disabilities brochure to every student at the beginning of each school year and at the time of initial enrollment. The brochure is available on the District s website at eeco.lausd.net and from the District s Supplies and Equipment Catalog (See Printed Forms and Publications - Educational Equity ) free of charge using the following Commodity Codes: English (50/package) Commodity Code: N/C Spanish (50/package) Commodity Code: N/C 1. Schools needing translated copies of the brochures in Armenian, Chinese, Farsi, Korean, or Russian should contact the Educational Equity Compliance Office, at (213) , to obtain originals of the translations for the requesting school to duplicate in the quantity necessary to meet the specific language needs of the individual school s student population. 2. 5 Attachment A LOS ANGELES UNIFIED SCHOOL DISTRICT NONDISCRIMINATION STATEMENT The Los Angeles Unified School District is committed to providing a working and learning environment free from unlawful discrimination and harassment. The District prohibits discrimination and harassment against any protected group as identified under Education Codes 200, 220, and Government Code 11135, including actual or perceived sex, sexual orientation, gender identity, gender expression, ethnic group identification, race, ancestry, national origin, religion, color, mental or physical disability, age, or on the basis of a person's association with a person or group with one or more of these actual or perceived characteristics, in any program or activity it conducts or to which it provides significant assistance. Discrimination is different treatment on the basis of a protected category in the context of an educational program or activity without a legitimate nondiscriminatory reason and interferes with or limits the individual s ability to participate in or benefit from the services, activities, or privileges provided by the District. Harassment occurs when: (1) the target is subjected to unwelcome conduct related to a protected category; (2) the harassment is both subjectively offensive to the target and would be offensive to a reasonable person of the same age and characteristics under the same circumstances; and (3) the harassment is sufficiently severe, pervasive, or persistent so as to interfere with or limit an individual s ability to participate in or benefit from the services, activities, or opportunities offered by the District. Once a school or office has notice of possible harassment of students or employees, whether carried out by employees, students, or third parties, it should take immediate and appropriate steps to investigate or otherwise determine what occurred and take prompt and effective steps reasonably calculated to end any harassment, eliminate a hostile environment, if one has been created and prevent the harassment or from occurring again. These steps should be taken whether or not an individual makes a complaint or asks the school or office to take action. This nondiscrimination policy covers admission or access to, or treatment or employment in all District programs and activities, including vocational education and affiliated or co-sponsored programs and activities. The lack of English language skills shall not be a barrier to admission or participation in District programs or activities. The District prohibits retaliation against anyone who files a complaint or participates in the complaint investigation process. 6 Attachment B DISTRITO ESCOLAR UNIFICADO DE LOS ÁNGELES DECLARACIÓN ANTIDISCRIMINATORIA El Distrito Escolar Unificado de Los Ángeles está comprometido a mantener un ambiente laboral y aprendizaje libre de acoso y discriminación ilegal. El Distrito prohíbe la discriminación y el acoso contra cualquier grupo protegido identificados bajo los códigos de educación 200, 220 y el código de Gobierno 11135, incluyendo sexo real o percibido, orientación sexual, identidad de género, expresión de género, identificación de grupo étnico, raza, ascendencia, origen nacional, religión, color, discapacidad mental o física, edad, o sobre la base de la Asociación de una persona con una persona o grupo con uno o más de estas características reales o percibidas, en cualquier programa o actividad o proporcionar una asistencia considerable. La discriminación es tratamiento diferente sobre la base de una categoría protegida en el contexto de un programa educacional ó actividad sin motivo legítimo antidiscriminatorio e interfiere con o limita la capacidad del individuo para participar en o beneficiarse de los servicios, actividades o privilegios proporcionados por el Distrito. El acoso ocurre cuando: (1) el objetivo es sometido a conducta no deseada en relación con una categoría protegida; (2) el acoso es subjetivamente ofensivo al destino y sería ofensivo para una persona razonable de la misma edad y características en las mismas circunstancias; y (3) el acoso es suficientemente severo, penetrante y persistente con el fin de interferir o limitar la capacidad del individuo para participar en o beneficiarse de los servicios, actividades u oportunidades ofrecieron por el Distrito. Una vez que una escuela o un departamento ha recibido notificación de posible acoso de estudiantes o empleados, ya sea llevadas a cabo por los empleados, estudiantes o de terceros, medidas inmediatas y adecuadas se tomarán para investigar o determinar lo ocurrido y tomar medidas rápidas y pasos eficaces para terminar cualquier acoso, eliminar un ambiente hostil, si uno se ha creado y evitar el acoso o un ambiente hostil que ocurra nuevamente. Estos pasos se deben tomar o no un individuo presenta una queja o pida a la escuela o la Oficina para tomar acción. Esta norma de antidiscriminacion cubre la admisión o acceso o tratamiento o empleo en todos los programas del Distrito y actividades, incluyendo la educación vocacional y programas afiliados o copatrocinados y actividades. La falta de conocimientos del idioma inglés no será un obstáculo para la admisión o participación en actividades o programas del Distrito. 7 Attachment C LOS ANGELES UNIFIED SCHOOL DISTRICT SEXUAL HARASSMENT POLICY The Los Angeles Unified School District is committed to providing a working and learning environment free from unlawful sexual harassment. The District prohibits sexual harassment of or by employees, students, or persons doing business with or for the District on the basis of actual or perceived sex, sexual orientation, gender identity or gender expression. Failure to follow this policy is a violation of state and federal law. Sexual harassment is defined by California Education Code as any unwelcome sexual advances, requests for sexual favors, and other verbal, visual, or physical conduct of a sexual nature made by someone from or in the work or educational setting, under any of the following conditions: Submission to the conduct is explicitly or implicitly made a term or a condition of an individual s employment, academic status, or progress Submission to, or rejection of, the conduct by the individual is used as the basis of employment or academic decisions affecting the individual The conduct has the purpose or effect of having a negative impact upon the individual s work or academic performance, or of creating an intimidating, hostile, or offensive work or educational environment Submission to, or rejection of, the conduct by the individual is used as the basis for any decision affecting the individual regarding benefits and services, honors, programs, or activities available at or through the educational institution The District considers sexual harassment to be a major offense which can result in disciplinary action to the offending employee or the suspension or expulsion of the offending student in grades four through twelve. Suspension or expulsion as a disciplinary consequence for sexual harassment shall not apply to students enrolled in Kindergarten and grades one through three, but these students may be subject to other disciplinary actions. Once a school or office has notice of possible harassment of students or employees, whether carried out by employees, students, or third parties, it should take immediate and appropriate steps to investigate or otherwise determine what occurred and take prompt and effective steps reasonably calculated to end any harassment, eliminate a hostile environment, if one has been created and prevent the harassment or from occurring again. These steps should be taken whether or not an individual makes a complaint or asks the school or office to take action. Any student or employee of the District who believes that she or he has been a victim of sexual harassment should bring the problem to the attention of the site administrator or the school s Title IX/Bullying Complaint Manager so that appropriate action may be taken to resolve the problem. The District prohibits retaliatory behavior against anyone who files a sexual harassment complaint or any participant in the complaint investigation process. Complaints must be promptly investigated in a way that respects the privacy of the parties concerned. 8 Attachment D DISTRITO ESCOLAR UNIFICADO DE LOS ÁNGELES NORMAS SOBRE ACOSO SEXUAL El Distrito Escolar Unificado de Los Ángeles está comprometido a proporcionar un ambiente laboral y aprendizaje libre de insinuaciones sexuales. El Distrito prohíbe el acoso sexual por parte de los empleados, los estudiantes o las personas haciendo negocios con o para el Distrito sobre la base de sexo real o percibido, orientación sexual, identidad de género o expresión de género. El incumplimiento de estas normas es una violación de las leyes estatales y federales. El acoso sexual es definido por el código de educación de California como cualquier conducta de índole sexual no deseada, pedir favores sexuales y otra conducta verbal, visual o física de naturaleza sexual hecha por alguien de o en el trabajo o el plantel educativo, bajo cualquiera de las siguientes condiciones: La sumisión a la conducta se hace explícita o implícitamente una condición de empleo, estado o progreso académico La sumisión a la conducta po el individuo o el rechazo de la misma se utiliza como base del empleo o de las decisiones académicas que afecten al individuo La conducta tiene el propósito o efecto de tener un impacto negativo en el trabajo o en el rendimiento académico del individuo o el afecto de crear un ambiente de trabajo o de estudio intimidante, hostil u ofensivo. La sumisión a la conducta del individuo o el rechazo de la misma se usa como base para cualquier decisión que afecta al individuo con respecto a las prestaciones y servicios, honores, programas o actividades disponibles en o a través de la entidad educativa El Distrito considera el acoso sexual ser una ofensa mayor que puede resultar en acción disciplinaria para el empleado infractor o la suspensión o expulsión del estudiante infractor en los grados de cuarto al doce. La suspensión o expulsión como consecuencia disciplinaria por acoso sexual no se aplicará a los estudiantes matriculados en Kindergarten y los grados de primero al tercero, pero estos estudiantes puede estar sujetos a otras acciones disciplinarias. Una vez que una escuela o la Oficina ha recibido notificación de posible acoso de estudiantes o empleados, ya sea llevadas a cabo por los empleados, estudiantes o de terceros, medidas inmediatas y adecuadas se tomarán para investigar o determinar lo ocurrido y tomar medidas rápidas y pasos eficaces para terminar cualquier acoso, eliminar un ambiente hostil, si uno se ha creado y evitar el acoso o un ambiente hostil que ocurra nuevamente. Estos pasos se deben tomar o no un individuo presenta una queja o pida a la escuela o la Oficina para tomar acción. Cualquier estudiante o empleado del Distrito que cree que él o ella ha sido víctima de acoso sexual decir el problema a la atención del administrador del sitio o el administrador de quejas de la escuela Título IX/intimidación para que puedan tomarse medidas adecuadas para resolver el problema. El Distrito prohíbe el comportamiento de represalia en contra de cualquier persona que presente una queja de acoso sexual o de cualquier participante en el proceso de investigación de la queja.
