1 Medical University of Graz CONVENIO PARA EL ESTABLECIMIENTO PROGRAMA DE INTERCAMBIO DE UN LA UNIVERSIDAD DE GUADALAJARA (Guadalajara - México) LA MEDICAL UNIVERSITY OF GRAZ (Graz - Austria) LA UNIVERSIDAD DE GUADALAJARA, en lo sucesivo denominada la UDG, con domicilio Av. Juárez 975, Col. Centro, México y representada por su Rector General Sustituto el Dr. Marco Antonio Cortés Guardado y la MEDICAL UNIVERSITY OF GRAZ, en lo sucesivo denominada la MUG, con domicilio Universitatplatz 3, 8010 Graz, Austria y representada por su Rector Univ. Prof. Dr. Josef Smolle, vinculadas por comunes intereses académicos y culturales, celebran el presente Convenio según las siguientes cláusulas: El presente tiene el objetivo de desarrollar un programa de intercambio y cooperación en todas las áreas de ciencias de salud ofrecidas en ambas instituciones. El programa de intercambio podrá incluir: a) Estudiantes de nivel licenciatura y posgrado; b) Personal académico e investigadores; c) Colaboraciones de investigación y formación El periodo de intercambio estudiantil será por un semestre o un año académico. El intercambio de estudiantes comenzará en agosto de 2010 (UDEG) y en octubre de 2010 (MUG).

2 El periodo de intercambio de personal académico e investigadores será establecido según cada situación y será de mutuo interés Los candidatos para el programa de intercambio deberán contar con competencia de idioma de instrucción (español o alemán) La facultad de la universidad receptora evaluará a los estudiantes solicitantes, según sus normas y reglas Será la responsabilidad de la universidad de origen reconocer los créditos obtenidos por las disciplinas y formación realizadas durante el intercambio Los candidatos de intercambio deberán someter todos los documentos requeridos para que sus solicitudes sean consideradas por la universidad receptora. La lista específica de documentos requeridos e instrucciones estarán disponibles a los candidatos interesados en cada institución Los estudiantes de intercambio se quedarán inscritos en su universidad de origen y pagarán los costos de inscripción y matrícula en ella. La universidad receptora no cobrará cuotas por estos conceptos Después de la terminación del periodo de intercambio, la universidad receptora enviará a la universidad de origen un informe con las calificaciones obtenidas o una confirmación de la formación académica realizada El número de estudiantes de intercambio no deberá exceder 2, cada uno por 12 meses, por año académico Los estudiantes de intercambio, personal académico e investigadores visitantes serán responsables por todos los gastos de alojamiento, transporte, tratamiento médico y costos personales, incluyendo excursiones, libros, alimentación y otros gastos incidentales que resulten del intercambio. Cada institución ayudará, tanto como sea posible, con los arreglos de alojamiento Los estudiantes, personal académico e investigadores que realizan actividades de intercambio deberán contar con cobertura de seguros médicos para el periodo de dichas actividades y un comprobante de inmunización requerida. Los estudiantes de la UDG deberán pagar la contribución de membrecía a la Representación Austriaca de Estudiantes (Osterreichische Hochschülerschaft) para garantizar la cobertura de responsabilidad. Las instituciones acuerdan que los costos de cobertura de seguros médicos y sociales son la responsabilidad absoluta de los candidatos visitantes.

3 Todos los candidatos de intercambio deberán apegarse a las moralidades y tradiciones del país anfitrión y la institución receptora. Para fomentar el entendimiento de las diferencias del estilo de vida, la cultura y el comportamiento esperado en el país anfitrión, cada institución receptora proporcionará información y/o instrucciones a los candidatos de intercambio antes de su llegada al país anfitrión Ambas instituciones expresamente no asumen responsabilidad por la mala conducta o negligencia de candidatos visitantes que están relacionados en cualquier manera a este programa de intercambio Un acuerdo individual sobre los términos y las condiciones de la estancia en la MUG deberá ser firmado por cada candidato visitante. No obstante, con la firma de este acuerdo individual los candidatos de intercambio no entrarán en relación laboral alguna con la MUG y no recibirán remuneración alguna de la MUG Ambas instituciones acuerdan que los derechos de cualquier propiedad intelectual que resulte de o en conexión con cualquier programa o actividad bajo este Convenio, a través de las esfuerzas conjuntas y colaborativas de ambas instituciones, serán poseídos conjuntivamente y estarán sujetos a cualquier término y condición acordada según las leyes y reglas relevantes, las regulaciones de la institución receptora, y los "Estándares de Buena Práctica Científica" de la institución receptora (si están disponibles). Ambas instituciones se esforzarán por obtener recursos de las instituciones mismas o de agencias de financiamiento para desarrollar las actividades bajo este Convenio. V.1 - Para realizar y cumplir con los objetivos de este Convenio, la UDG y la MUG nominarán a una persona adecuada de su personal para coordinar el desarrollo y la conducta de actividades conjuntas. A través de estas personas de contacto, una de las dos instituciones podrá presentar propuestas para actividades que serán establecidas. V.2 - Los coordinadores tendrán la misma responsabilidad por igual en la evaluación de actividades bajo este Convenio según las prácticas establecidas en sus instituciones respectivas.

4 VI.1 - Este Convenio entrará en vigor a partir de la fecha de su última firma y tendrá vigencia de 5 (cinco) años. Podrá ser modificado o extendido a través de un documento apropiado firmado por ambas partes. VI.2 - Este Convenio podrá ser terminado por una de las dos instituciones con notificación por escrito a la otra, la cual entrará en vigor 90 (noventa) días a partir de su recibo. VI.3 - La terminación del Convenio no afectará cualquier actividad que esté en progreso. Para resolver cualquier litigación que pudiera surgir entre las partes, se designará el tribunal del país en donde toma lugar la litigación. VII1.1 - El Convenio es una declaración completa y exclusiva del acuerdo entre las Partes con respecto del contenido del mismo. Este Convenio sólo podrá ser modificado por escrito por los representantes autorizados de ambas Partes. VII1.2 - Este Convenio será ejecutado en dos copias en idioma inglés y dos copias en español, dos para la UOG y dos para la MUG, cada uno de los cuales será considerado un original. 5 AGREEMENT FOR THE ESTABLISHMENT OF A EXCHANGE PROGRAM UNIVERSIDAD DE GUADALAJARA (Guadalajara - Mexico) MEDICAL UNIVERSITY OF GRAZ (Graz - Austria) UNIVERSIDAD DE GUADALAJARA, hereinafter referred to as UDG located at Av. Juárez 975, Col. Centro, Mexico, represented by its Acting General Rector, Dr. Marco Antonio Cortés Guardado and MEDICAL UNIVERSITY OF GRAZ, hereinafter referred to as MUG, located at Universitaetsplatz 3, 8010 Graz, Austria, represented by its Rector Univ.-Prof. Dr. Josef Smolle, linked by common academic and cultural interests, set forth the present Agreement according to the following c1auses: The present Agreement is aimed at developing an exchange program and cooperation in all the health sciences areas offered at either the two Institutions. The exchange program may include: a) Undergraduate and Graduate students; b) Professors and researchers; c) Research and training collaborations The student exchange period will be from one semester to one academic year. The exchange 2010 (MUG). of students will start in August 2010 (UdeG) and October

6 The exchange period for professors and researchers will be set according to each situation and shall be of mutual interest Candidates to the exchange program must have knowledge of the language in which c1asses will be taught (Spanish/German) Students will be assessed by the faculty of the University that the student is visiting, according to its rules Recognizing credits for the disciplines or trainings taken through exchange will be responsibility of the home Institution In order to have candidate's request considered by the visiting Institution, they must submit all the documents demanded at the time. The specific documents and instructions shall be included in the information packages made available to interested candidates at each Institution Students from each University will remain registered at their home University, where they will pay all academic fees, including tuition, and will be granted exemption from the normal tuition fees at the host University At the end of study abroad period, students will receive a confirmation of academic training and of exams passed at the host institution The number of students exchanged should not exceed 2, each for 12 months, per academic year Accommodation, transportation, and personal expenses, including outings, books, consumables and other incidental expenses arising out of the exchange as well as the expenses of medical treatment if unfortunately necessary, are the responsibility of the visiting students, professors, and researchers. Each Institution shall assist as far as possible with housing arrangements Students, professors and researchers taking part in exchange activities shall have international health and social insurance valid during those activities and must show evidence of required immunization. In any case the visiting students have to pay the membership-contribution to the Austrian Student Representation (Osterreichische Hochschülerschaft) so that liability coverage is guaranteed. The institutions agree that the costs for health and social insurance coverage are entirely beard by the visiting candidates concerned.

7 AII exchange candidates should follow the morals and traditions of the hosting country and the hosting institution. To foster the understanding of differences in lifestyle and culture and subsequent expected behavior in the host country each host institution provides the medical exchange candidates information material and/or instructions prior to or at their arrival in the hosting country th institutions expressly do not assume any liability for the misbehaviour or negligence of visiting candidates which are related in any way to this exchange programo An individual agreement about the terms and conditions of the sojourn at MUG has to be signed by each visiting candidateo However, with this individual agreement the exchange candidates do not enter into any relation of employment with the MUG and will not obtain any kind of financial compensation by the MUG th institutions agree that any intellectual property rights arising from or in connection with any program or activity under this Agreement, through and by the joint and collaborative efforts of both institutions, shall be jointly owned and subject to any other terms and conditions as may be agreed upon according to the relevant legal regulations, the host institution's internal regulations, and the "Standards of Good Scientific Practice" of the host institution (if available)o 80th Institutions will strive to obtain resources from the Institutions themselves or from financing agencies to develop the activities under this Agreement. V.1 - In order to carry out and fulfill the aims of this Agreement, UDG and MUG will appoint an appropriate person from their staff to coordinate the development and conduct of joint activities. Through these contact persons, either Institution may present proposals for activities that shall be established. V.2 - The coordinators will be equally responsible for the evaluation of activities under this Agreement according to the established practices in their respective Institutions o VI.1 - This Agreement shall take effect on the date the last required signature is appended hereto and shall be valid for 5 (five) years thereafter. It may be amended or extended, by a proper document signed by both parts.

8 VI.2 - This Agreement may be canceled by either Institution by giving to the other part a notice in writing which shall take effect in 90 (ninety) days upon receipt. VI.3 - The end of the Agreement shall not bring to a c10se of any activity in progress. To solve any litigation that may arise between the parts, it is designated the Court of the country where the eventual Iitigation takes place. VII1.1 - This Agreement is a complete and exclusive statement of the agreement between the Parties concerning the subject matter hereof and supersedes all proposals or prior agreements, oral or written. This Agreement can only be modified in writing by the duly executed representatives of both Parties. VII1.2 - This Agreement shall be executed in four counterparts in English and Spanish, being two for UDG and two for MUG, each of which shall be deemed an original. As witnesses to their subscription to the above articles, the appropriate authorities, representing UDG and MUG have hereunto set their signatures in four copies in English and Spanish. r.
